Bail is an agreement with the court and the defendant or another third party where the defendant is allowed to stay out of custody on agreement that he/she would return on every court hearing and proceedings that takes place in the future On this agreement the defendant pays a surety pledge in cash to the court which is forfeited once the defendant fails to appear before the court
