The NHS was formed in 1948 as part of an ambitious plan to provide quality healthcare to all citizens and to be paid for by taxes. The NHS is available to all and covers a huge range of health care services. But increasingly many are wondering just how responsible the NHS is for the health of the people.

The AA has told MPs that, unless steps are taken, motorists will continue to see an increase in insurance premiums for the foreseeable future. In a meeting with the Transport Select Committee, the president of the AA revealed that the rise in premiums was in direct correlation with the number of personal injury compensation claims.

A study carried out by the Division of Health Care and Outcome Research in Toronto, Canada has arrived at some controversial conclusions that are sparking debate amongst the medical and legal communities. The study, carried out by Dr Pierre Cote, suggests that the process of seeking compensation for a whiplash injury can actually impede recovery.

Australian Book Clarifies Whiplash Symptoms

While whiplash is the most commonly faked or exaggerated personal injury in the UK, it seems that, in this country, we are no closer to fully understanding its causes, effects and symptoms.

Because of an increase in high profile compensation payouts for medical negligence, doctors are becoming more 'risk aware' in their work. This apparent 'risk aware' culture could be compared to how doctors work in the US, where a culture of compensation and 'ambulance chasing' has received much negative publicity in the UK.

Despite the AA's revelations that the UK has the safest roads in Europe and the fewest number of recorded accidents per year, the number of whiplash claims continues to rise, far outstripping the statistics of our European counterparts.

According to figures released by the Scottish Government, the bill for people suing NHS Scotland has achieved a record high. Currently standing at 1.27million pounds, the figure is expected to total 2.5million pounds by the time the financial year is over.

There is increasing concern amongst health industry experts that the rising costs of medical negligence compensation payouts are taking money away from essential NHS services.

According to a report by the GMB Union, more than 1 million schoolchildren are being put at risk every day because school support staff are being asked to perform medical procedures with little or no training.

Motoring insurance costs rose by an average of 40% in 2009, more than 10 times the Consumer Price Index measure of inflation and the largest annual rise since the AA began collecting data in 1994.

With the amount of compensation claims expected to total over 80 million pounds for 2010, it would be reasonable to assume that the NHS would be doing everything in its power to reduce the potential for medical negligence claims to be levied against it. However, if there is substance to the revelations made by NHS Choices, then the reverse is true.

The plight of a British businesswoman who underwent cosmetic surgery has thrown the potential cost of medical negligence back into the spotlight. Although the claim was launched in 2007, it has taken four years to reach its conclusion, resulting in a landmark payout for cases of this kind.
