In and Outs of a Tenancy Agreement

Assured Shorthold Tenancy Agreements (ASTs) are the default form of tenancy agreement where annual rent does not exceed 100,000 GBP.

In July 2009 the Office of Fair Trading notched up a victory against use of unfair contracts. Although the contract in question was between a letting agent and a landlord, the High Court decision was also a reminder to landlords that their tenancy agreements should not contain unfair terms.

When moving into rented accommodation, tenants sign a tenancy agreement which means they cannot be removed immediately, or at all without proper notice. Landlords however, are assured that when the tenancy agreement ends they can regain possession of their properties.

From Oct 2008 Energy Performance Certificates (EPCs) will be added to the documentation buy to let investors will be required to provide tenants. The Certificates will cost in the region of 100 pounds, and will be valid for up to ten years.
