Conveyancing – points to keep in mind before the process
Conveyancing is a branch of law which deals with the transfer of the conveyance of property from one person to another. The process involves examining titles, offering assessments as to their validity and the drawing of deeds. When we talk of conveyance, it indicates the transfer of property in the name of one person, to another. This property may be freehold or leasehold. Usually the legal matters linking to conveyancing take a lot of effort and time. The process requires one to have all the legal knowledge concerning the matter. Since no one has the time to personally equip themselves with all the legal knowledge, which itself takes a long time to acquire; it is always in one’s best interest to seek a conveyancing solicitor who is a professional in such matters. The main motive of conveyancing is to secure the interest and protect the rights and information of the buyer, i.e. the person in whose name the property or real estate is being transferred. The buyer must be notified in advance of his/her rights against the price or barter the pay for the land, and also any restrictions for selling or other activities after the transfer of the land. He/she must ensure that they have acquired good or marketable commercial land and must safeguard himself/herself against any cheat or hidden costs or hidden liabilities. The process is two-fold, with the initial step - the exchange of contracts between the two parties and where the “equitable” title is passed and the second step - the legal title is passed on to the buyer and this is called the “completion” of the process. One can find conveyancing solicitors through a known source, an advertisement or through the internet. One must always check the professionalism in the regulating body with which the solicitor is associated. One can also find assistance even in case one is in a foreign country. When the client asks for a “Conveyancing quote”, it is a legal obligation for the solicitor to disclose the costs and other matters related with the services offered by them. This must include the amount of costs (if known), the basis on which the cost is calculated in case the cost in not known, the billing arrangements, the clients’ rights regarding the fees etc, and other matters concerning the same, if any. The conveyancing process differs from country to country varying upon the laws, processes etc. of the respective country. In the UK, the conveyancing process is either done by a solicitor or a licensed conveyancer. The licensed conveyancer may be unqualified, but experienced; but is it always advisable to go for a professional solicitor. The conveyancing price or quote in the market is highly competitive, with a large number of conveyancing on offer.
