You may be surprised to learn that bill collection agencies are subject to a code of ethics. Since harassment and intimidation seem to be one of the hallmarks of their methods of operation, it is no wonder that this fact seems simply unbelievable at first.

Maybe you have experienced some of these heavy-handed tactics yourself. Perhaps you know a friend or family member who has fallen victim to repeated nasty phone calls at work, or at home at all hours of the day and night.

It used to be that bill collectors could do just about anything to make people pay, but that has all changed. In fact, the Congress of the United States recognized the huge problem and instituted the FDCPA, or Fair Debt Collection Practices Act.

This act was brought forth in 1978 as part of the Consumer Credit Protection Act. It is designed to give debtors much needed power when confronted by a demanding voice at the end of the phone line.

Consumers now have a way of questioning the validity of the collectors claim, by demanding and getting pertinent information regarding the actual crucial details.

Things such as the name of the creditor, the amount of the debt, and exactly who it is that's calling, should not be hidden fro
m the debtor. The FDCPA gives the average person the right to demand answers to these questions.

The act also spells out strict guidelines that govern the entire bill collection industry in order to stop threatening and abusive practices. These guidelines are backed up with specific solutions and punishment for those companies who cross the line.

It is good to remember that harassment is unlawful and any such behavior should not be tolerated. Amazingly it still often occurs, because collection agencies often will take chances, knowing that many people have no idea that they have rights under the FDCPA.

No doubt you are like most people, who borrow money and use credit cards, never intending to run into problems. It doesn't take much for your lifestyle to take a turn for the worse. Health problems, layoffs, or an accident can put a serious damper on your income.

Before you know it, you've missed scheduled payments, and when the past due notices start piling up, the collection agencies won't be far behind.

If you are being harassed or bullied, remember that there is help available to get you through this trying time. Obtaining the services of a fair debt lawyer will stop the nastiness and help get you monetary compensation from the bill collectors themselves. You won't have to pay legal costs either.
